A class action settlement will affect your rights if you worked for Reyes Coca-Cola Bottling, L.L.C. in California during the period from July 17, 2018 through November 11, 2020 and received one or more paper paychecks (as opposed to direct deposit) during that period.
- On or about September 23, 2019, Jazmin Serrano (“Plaintiff”) filed a representative lawsuit against Reyes Coca-Cola Bottling, L.L.C. (referred to as “Defendant”) on behalf of herself and other non-exempt employees of Defendant. This lawsuit is entitled Jazmin Serrano vs. Reyes Coca-Cola Bottling, L.L.C., and DOES 1 to 100, Inclusive, Los Angeles Superior Court Case No. 19STCV33690 and seeks civil penalties under the California Private Attorneys General Act (“PAGA”) for alleged violations of California Labor Code Sections 201, 202, 203, 204, 226, 226.7, 510, 512, 1194 and 1198. On or about November 23, 2020, Plaintiff filed a second lawsuit asserting the same claims asserted in the prior lawsuit, but also adding a class action claim based on violation of Labor Code section 226. The second lawsuit is titled Jazmin Serrano vs. Reyes Coca-Cola Bottling, L.L.C., and DOES 1 to 100, Inclusive, Los Angeles Superior Court Case No. 20STCV45012. Both lawsuits are collectively referred to in this Notice as “the Lawsuits” or “the Action.”
- Plaintiff, and the Defendant have entered into a settlement agreement covering the claims in the Lawsuits, which is subject to court approval. The Court in charge has preliminarily approved the settlement. The Court still has to decide whether to grant final approval of the settlement. Payments will be made only if the Court grants final approval of the settlement and after any appeals are resolved.
- If you were employed by Defendant in California at any time during the period from July 17, 2018 through November 11, 2020, and received one or more paper paychecks (as opposed to direct deposit) during that period, you could receive money from the settlement.
